ARTICLE 1 : Area of application
The terms and conditions of sale applies to all transactions conducted between ourselves Lela Presse and you the customer on our web site www.avionsbateaux.com via the internet or orders received via mail or fax. No terms and conditions other than the terms and conditions contained herein shall be binding upon Lela Presse unless accepted in writing. All terms and conditions contained in any prior oral or written communication, which are different from or in addition to the terms and conditions herein are hereby rejected, whether or not they would materially alter this document. Lela Presse reserves the right to amend the present terms and conditions of sale. Any such modifications will be published here.
ARTICLE 2: Ordering
Lela Presse undertakes to process your order under the terms and conditions of sale, which can be consulted here on our website. It is important that you familiarise yourself with these. Any e-mail or other electronic acknowledgement by us of receipt of an order placed by you does not constitute legal acceptance by Lela Presse of your order. All orders are subject to approval by us. Placing an order automatically implies acceptance of our terms and conditions of sale. On placing an order on the web site of Lela Presse you enter into a binding contract. Orders can also be placed by electronic mail, postal services or fax. Payment may be made via credit card (Visa or Eurocard Mastercard) or personal cheque in Euros drawn on a French bank account.
ARTICLE 3 : PRICING
All our prices are net and indicated in Euros. Prices indicated may be subject to change without notice. The price charged is that in force at the time the order is received. While we will try to ensure that prices on the website are accurate, we are not responsible for errors that may occur. The Euro/French Franc exchange rate is fixed at 6.5597FF to the Euro. Lela Presse reserves the right to amend the prices of books, magazines and kits without notice. The price charged is that in force at the time the order is received.
ARTICLE 4 : PAYMENT
We offer secure payment facilities. We accept credit card payment via Visa or Eurocard Mastercard. Our secure order form incorporates industry-standard SSL encryption. The card number should be entered with no spaces between the figures along with the date of validity of the card. We accept cheque payment, if drawn in Euros on a French bank account, payable to Lela Presse. Cheques are cleared prior to order dispatch.
ARTICLE 5 : SHIPPING AND ACCEPTANCE
We undertake to expedite all orders speedily. Delays that may occur in the receipt of the order over the internet do not entitle the customer to cancel the order, to refuse to take delivery of the order or to claim damages or interest. Any claim regarding non-conformance, the incorrect processing of an order, whether received via download or post, should be communicated within seven days of receipt of the order. Supply of goods not published by Lela Presse can occasionally be subject to delay from our suppliers and contractors.
Orders for books that are in stock are usually processed and shipped within 2-3 working days but this cannot be guaranteed. Lela Presse accepts no liability or responsibility where our suppliers or publishers experience problems with the supply of certain products.
Within France and fifteen countries of the European Economic Union (Germany, Austria, Belgium, Denmark, finland, Great Britain, Ireland, Luxembourg, Norway, Holland, Sweden, Switzerland, Spain, Italy and Portugal) all orders are dispatched via Colissimo Suivi, a priority rapid mail service offered by the French Post Office. Magazines with a parity commission number are dispatched with the standard Presse frank. Elsewhere postal charges are calculated on the basis of weight and dispatch zone.
ARTICLE 6 : WARRANTIES
In addition to your statutory rights under articles 1641 and subsequent articles of the French Code Civil all products are covered against defects by the publisher's warranty. We exclude those warranties and conditions relating to fitness for a particular purpose or suitability or loss of use of the item. Liability of Lela Presse is excluded in the event of a claim for breach of warranty or condition not already covered under the conditions of sale.
ARTICLE 7 : SUSPENSIVE CLAUSE
Should the customer fail to meet his obligations either partially or in full and particularly with regard to the case of non-payment of some or all monies owed, the contract between Lela Presse and the customer - without prejudice to any other rights - for all or any other deliveries to be made under that or any other contract with the customer shall be suspended. In such event the customer shall not in any respect be released from its obligations to Lela Presse under that or any such other contract. Lela Presse shall also be entitled to treat the relevant contract or any other contract with the customer as having been terminated by the customer and to claim damages for breach of contract accordingly. No liability will be accepted for loss or damages that may be claimed as a result of this termination.
ARTICLE 8 : DISCLAIMER
Any goods, services or information displayed on this website should not be regarded as an offer, invitation, solicitation, advice or recommendation to buy products or services on the website. No warranties or representations are made about any goods not specifically published by Lela Presse. Titles not published by Lela Presse are advertised based on the information received from their publishers. Lela Presse is not responsible for the content of these works and liability is hereby excluded. Articles offered for sale on this website conform to all French legal requirements. Lela Presse makes no promise or representation that goods purchased will conform to any federal, state or local laws, regulations, codes or standards in the country where acceptance takes place (censorship or ban applying to an author or title). In addition the customer accepts that there is some risk with all transactions conducted over the internet, which may be open to malicious attacks by hackers and criminals, especially when transmitting information via countries that do not have adequate systems of fraud protection in place. In placing his order the customer accepts that while all reasonable care is taken to protect the confidentiality of his credit card details Lela Presse cannot be liable, if, through no fault of its own, these details are intercepted as a result of a malicious attack by hackers or criminals.
ARTICLE 9 : SECURITY AND FRAUD PREVENTION
We are committed to protecting your privacy. Lela Presse will only use the information that we collect about you in strict confidentiality. In processing your order we require you to provide the following information - name, surname, address, e-mail address- in order to be able to provide you with the best possible service. All reasonable care will be taken with regard to the confidentiality of personal information we hold on file. In placing an order the buyer accepts that that a file will be created containing all the relevant information required by Lela Presse to process the order. Such information may be transmitted to third parties for marketing purposes. You may withhold your consent by notifying us in writing.
While all reasonable care is taken to protect the confidentiality of your credit card details, Lela Presse cannot be liable if, through no fault of its own, these details are intercepted by and used by third parties.
All personal details are handled in accordance with the Data Protection Act (No. 78-17 of 6 January 1978) in accordance with the submission of Lela Presse to the CNIL- the National Commission for Data Protection
The information we hold will be accurate and up to date. Under the terms of the Data Protection Act you can check the information that we hold about you by emailing the site administrator. If you find any inaccuracies we will delete or correct it promptly. In placing an order here you accept that you understand our fraud prevention policy and authorise us to process and exploit the information thus collected.
We use website log files to track and report on the patterns of behaviour of visitors to our site. This site also uses cookies that are stored on your browser. You can modify your browser settings to prevent this happening but this site will not perform correctly if you do. In the event that one or several stipulations of the present sale conditions fail to conform to any federal, state or local laws, regulations, codes or standards, the remaining clauses will not be invalidated. The parties will agree to substitute the invalid clause with another closest in content to the disputed clause in order to preserve the economic balance of the contract.
ARTICLE 11 : INTELLECTUAL OWNERSHIP AND COPYRIGHT
The copyright on all material that we publish, whether on this site or in printed form is held by Lela Presse. Except as stated herein, none of the material may be copied, reproduced, distributed, republished, downloaded, displayed, posted or transmitted in any form or by any means, including, but not limited to, electronic, mechanical, photocopying, recording, or otherwise. You may not use any proprietary notices, trademarks or logos appearing on any of our works, downloaded or printed materials. All rights are reserved and remain the exclusive property of Lela Presse.
ARTICLE 12 : ACCEPTANCE BY THE BUYER
The buyer hereby fully acknowledges and accepts the net sales price as stipulated on the website. The buyer acknowledges that Lela Presse does not make and specifically negates, renounces and disclaims any representations, warranties and/or guaranties of any kind or character, expressed or implied, with respect to the products sold on this website and the terms and conditions of sale. The buyer acknowledges that all data recorded by Lela Presse in respect of any transaction constitutes the legal basis of that transaction.
ARTICLE 13 : APPLICABLE LAW
Unless specified by written waiver, the buyer hereby agrees to the terms and conditions of sale when confirming any order notwithstanding any contrary clause stipulated in this notice. Any complaint must be addressed in writing to Lela Presse at its business address. Any dispute in respect of this contract or relating to non-payment will be resolved by the Tribunal de Commerce in Boulogne sur Mer, France, the only competent authority notwithstanding the delivery address or the method of payment.
